Terms of Sale

These terms apply when you buy a licence for software made by Silent Storm Technologies ("we", "us"), such asPixelCheck and SwitchCommander, and when you use that software. By buying or using it, you agree to them.

Who you buy from

Our online store is run by Lemon Squeezy, which is the merchant of record and reseller for all orders. Lemon Squeezy processes your payment, charges any applicable tax and issues your receipt, under its own buyer terms. The licence to use the software is granted by us, under these terms.

Your licence

When you buy, we grant you a non-exclusive, non-transferable licence to install and use the software, subject to these terms:

  • PixelCheck: one licence key can be active on up to 4 computers at a time.
  • SwitchCommander: one licence key can be active on one computer at a time.

You can move a licence to another computer with the app's Move to another computer option. The software checks your licence online when it starts and works offline for up to 30 days between checks. The licence is perpetual: it does not expire, as long as you follow these terms.

What you may not do

  • Share, resell, rent or publish your licence key, or use it on more computers than your licence allows.
  • Get around the licence check or any other technical limit in the software.
  • Copy, modify, reverse engineer or decompile the software, except where the law allows it regardless of this term.

We may deactivate a licence key that is used in breach of these terms.

Updates

The apps install updates automatically. Updates we release for a product are included with your licence. We may change, add or remove features over time, and may in future offer a new major version as a separate paid product; if we do, the version you bought keeps working.

Refunds

See our refund policy. In short: if it doesn't work for you, ask within 14 days for a full refund.

Using it on real systems

Our software sends lighting data and network switch configuration to real equipment. You are responsible for checking what you send, keeping your own backups, and testing changes before relying on them in a live show or production network.

Warranty

We work hard to make our software reliable, but it is provided "as is", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. Some places don't allow these exclusions, so they may not all apply to you.

Limitation of liability

To the fullest extent the law allows, we are not liable for any indirect, incidental, special or consequential damages, or for lost profits, data, revenue or equipment downtime, arising from your use of the software. Our total liability for any claim is limited to the amount you paid for the licence the claim relates to. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer under the law where you live.

Governing law

These terms are governed by the laws of the Commonwealth of Pennsylvania, United States, without regard to its conflict-of-law rules.

Changes

We may update these terms; the date at the top of this page shows when they last changed. The terms in force when you bought apply to that purchase.
